Heard learned counsel for the parties.

This is an application by the Appellant for return of original documents mentioned in paragraph No. 4 of the application (2 photo-passes and rent receipt marked Exh.16, 23 & 24 Colly). The Applicant has stated in the application that he is ready to furnish true copies of the said documents for substitution and he undertakes to furnish original documents as and when required by the Court. 3.

Considering the said statement/undertaking and the provisions of Order XIII Rule 9 of the Civil Procedure Code, 1908, the application is allowed in terms of prayer clause (a) which read as under:

"(a) That by an Order of this Hon'ble Court, the Registrar, Appellate Side of the Hon'ble Court, Bombay, be directed to return the original document more particularly mentioned in paragraph No.4 at Serial No.(a) to (c) to the Applicant Husen

8 IA-12200-2025.doc and be pleased to permit the Applicant to substitute the original document particularly mentioned in paragraph No.4 at Serial No.(a) to (c) by furnishing the true copies of the said documents."
