The prayer for amendment of the prayer portion of the Interim Application made by the learned counsel for the Applicant is allowed. The amendment be carried out forthwith. 2.

This Interim Application No.12427 of 2025 has been filed with a prayer to restore the connected Writ Petition being Writ Petition (St.) No.13080 of 2019, which was dismissed, as per the order of the Registrar, Judicial-I, dated 1st September, 2021, due to PRIYA RAJESH SOPARKAR PRIYA RAJESH SOPARKAR Date: 2025.10.14 18:25:39 +0530

failure on the part of the Applicant/Writ Petitioner to remove the office objection.

Mr. Ajit Kenjale, learned counsel appearing for the Applicant/Writ Petitioner submits that although, during the pendency of the Writ Petition, grievance of his client has been redresssed, and therefore, he has instructions to withdraw the Writ Petition, yet, unless the Writ Petition is restored, the order of withdrawal of the Writ Petition may not be permissible. Therefore, this Interim Application for restoration of the Writ Petition. 4.

Mr. A. I. Patel, learned Addl. GP for the State is present and does not have any objection to the prayer.

After going through the explanation furnished in the Interim Application, we are inclined to allow the prayer and set aside the order dated 1st September, 2021. However, since the Petitioner has already instructed the learned counsel to withdraw the Writ Petition, therefore, restoration of the Writ Petition merely for the purpose of the withdrawal of the same, in our opinion, would be a useless formality, consuming time of the Registry as well as of the Court. Therefore, while granting the prayer in the Interim Application, for setting aside the order dated 1st September, 2021, we also permit withdrawal of the connected Writ Petition on the ground of deemed restoration of the same.

Registry to accordingly correct the classification of the Writ Petition by removing "rejected Register No.1838" and assign original number of the Writ Petition for the purpose of showing it as disposed, as withdrawn.
