Heard the learned Counsel for the parties.

This is an application for condonation of 5 days delay in filing the Second Appeal.

Learned Counsel for the Respondent informed the Court that against the very impugned order, the Respondent has also filed a Second Appeal being 116 of 2025. Learned Counsel submits that the applicant has not been diligent in taking steps to file this cross appeal. 4.

Though, by an order dated 9 June 2025, to facilitate the resolution, SA No.116 of 2025 was adjourned at the instance of the Respondent therein - Applicant herein. Since the cross appeal against the very same order which is impugned in this appeal i.e. SA No.116 of 2025 is pending before this Court and for the reasons assigned in the instant application, it would be expedient SSP 1/2

23 ia 12457 of 2025.doc in the interest of justice that the delay of 5 days is condoned and both the appeals are heard together.

The Interim Application, thus, stands allowed. 6.

Delay in filing the Second Appeal stands condoned. 7.

The appeal be numbered and listed for Admission along with SA No.115 of 2025 on 19 November 2025.
