By a separate order in the Second Appeal, this Court has framed the substantial questions of law, which are arise for consideration. Since the Occupation Certificate was obtained SANTOSH SUBHASH KULKARNI on 26th March, 2018 and, eventually, the possession of the SANTOSH SUBHASH KULKARNI Date: 2026.05.04 10:59:40 +0530 subject apartment came to be delivered to the allottees in the year 2024 and 2025 respectively, during the pendency of the appeal there shall be interim relief in the following terms: (a) The allottees - respondents shall be permitted to withdraw only 50% of the amount deposited by the appellant pursuant to the order passed by the 1/2

(b) The balance 50% amount shall remain invested in a Fixed Deposit Account till further orders.
