Heard learned Advocate for the Petitioner/Defendant and learned Advocate for the Respondent-Plaintiff, and also heard learned Senior Advocate for the Intervenor and learned Advocate for CIDCO Respondent Nos. 2 to 5.

Today matter is taken on board because the Petitioner and Respondent No. 1 have settled the matter. There is serious objection for recording the settlement by way of consent terms in these writ petitions on behalf of the intervenors.

The issue involved in these two petitions is about correctness of the order passed by the trial court thereby rejecting the request in prelitigation mediation and refusing to grant time for filing written statement. The suit is commercial suit pending before the District Court, Belapur.

The Petitioner on the basis of the instructions submitted that he will file those consent terms before the trial court and in view of the settlement, he does not want to prosecute these writ petitions. The Respondents are not objecting for withdrawal. 5.

In view of that Writ Petitions are disposed of as not pressed. 6.

Parties if they want they can file consent terms before the District Court, Belapur. The intervenor is at liberty to file the application for intervention and other reliefs before the District Court. If such application is filed, the District Court is at liberty to decide the same as per the merits.

Contention of all the parties are kept open.
