2025.11.11 18:04:04 +0530 Intervenor) has sought impleadment as party Respondent No. 2 in the present Writ Petition.

The Applicant is the auction purchaser of the immovable property being the secured asset described as Flat No. 203, 2nd Floor, B Wing, Building No. 2, Balkum CHS, Ashok Nagar, Thane (W) ("the said property") purchased in e-auction process conducted by the Respondent-Bank under the provisions of Securitisation Act, 2002. 3.
The Applicant has stated that he had participated in the e-auction sale conducted by the Respondent-Bank on 28th March 2025 and paid amount of Rs. 5,56,000/- as earnest money deposit. At the e-auction sale, the Applicant was declared as highest and successful bidder and sale confirmed in favour of the Applicant for a total consideration of Rs. 55,65,000/- and sale intimation letter dated 28th March 2025 was issued by the Respondent-Bank in favour of the Applicant. The Applicant has paid an amount of Rs. 8,35,250/- on 29th March 2025 in accordance with auction sale. 4.
The Applicant has relied upon the Sale Certificate dated 4th June 2025 which has been issued by the Respondent-Bank in favour of the Applicant as successful e-auction purchaser of the subject flat.

In view thereof, we allow the Application directing the Petitioner to implead the Applicant as party Respondent No. 2 in the Writ Petition.

At this stage, the original Petitioner has tendered draft amendment, which is taken on record and marked "X" for identification.

The Petitioner shall carry out amendment by joining the Applicant as Respondent No. 2 and is also permitted to carry out amendment in terms of draft amendment marked X within a period of one week from the date of this order.

Re-verification is dispensed with.

Interim Application is accordingly, disposed of. 10.
Writ Petition, upon being amended, shall be served upon the Respondents including the newly joined Respondent No. 2. 3/4

Writ Petition shall be placed for consideration on 1st December 2025.
