Learned counsel for the appellant states that respondent No.1 was not served and hence, by order dated 10th April 2025, the appeal along with Interi Application No.18846 of 2022 came to be dismissed against respondent No.1. He makes statement that he will take steps to serve respondent No.1 by substituted service since respondent No.1 was not served at the time of the dismissal of the case against him. 2.

Reason mentioned in the application for condonation of delay satisfactorily explains the delay. Hence, the application is allowed and stands disposed of.

The appeal along with Interim Application No.18846 of 2022 stands restored against respondent No.1. In case, no steps are taken within a period of four weeks, this order shall stand vacated and appeal and the said interim application shall stand dismissed against respondent No.1.
