Heard learned counsel for the applicant. He seeks restoration of the F.A. (St.) No. 5112 of 2020, which came to be dismissed against respondent No.5.

It is the contention of the learned counsel for the appellant that since the notice was not served upon the respondent No.5 of the appeal, a notice of this application to this respondent be dispensed with. 3.
A perusal of the application indicates that the delay has been explained satisfactorily no malafides can be attributed against the applicant for not filing the application in time. Hence, application is allowed in terms of prayer clauses (a) and (b). He undertakes to take 1/2

It is clarified that if no steps are taken to serve the respondent No.5 within a period of eight weeks, the appeal shall stands dismissed. 5.
