The Petitioners by this Writ Petition have impugned the Orders dated 12th March 2024 passed by DRAT in Misc. Appeal No.41 of 2024 and Order dated 28th February 2024 passed by DRT in S.A. No.430 of 2024. Further, the Petitioners have impugned the Order dated 3rd February 2023 passed by the District Magistrate Pune (Tehsildar-Haveli, Pune) and has sought for setting aside of the said Orders.

The urgency in moving the present Writ Petition and taking out Interim Application No.12993 of 2025 therein is that the Respondent-Bank is conducting an auction of the secured asset / subject premises on 13th November 2025 which the Petitioners have alleged is in complete breach of the directions passed by this Court vide Order dated 11th June 2024. 3.
Mr. D'souza, Learned Counsel appearing for the RespondentBank states on instructions that the Respondent-Bank is not conducting the auction of the secured asset / subject premises on 13th November 2025. In the event, the Respondent-Bank desires to hold an auction of the subject premises, two weeks' notice shall be given by Respondent No.1-Bank to the Petitioners. Statement is accepted.

In view of the above statement, Mr. Engineer, Learned Counsel for the Petitioners has sought leave to withdraw the Interim Application for amendment of the Writ Petition.

Accordingly, the Interim Application No.12993 of 2025 is disposed of as withdrawn.

The Writ Petition shall be placed on 25th November 2025 for consideration.
