P. C. :- 1) The Applicant during pendency of the Writ Petition filed by him praying for quashing and setting aside the Look Out Circular issued by the Respondent No.3 i.e. Bank of Baroda at Mumbai seek permission to travel to Australia and New Zealand between 19/11/2025 to 21/12/2025. 2) Heard learned Counsel for the Applicant and perused the Application.
3) It is the case of the Applicant that he being appointed as a Non-Executive Independent Director of M/s. Winsome Diamonds and Jewellery Limited, had resigned in the year 2013 and even while he was working in the capacity of Director, he was not authorized to enter into transactions on behalf of the Company and in fact he has no role to play in 1/3
the day-to-day activities of the Company. However, when an LOC is issued by the bank referring to his involvement, he filed Writ Petition alleging that the issuance of such notice is ultra vires of the powers of the Bank by relying upon the decision of this Court in case of Viraj Chetan Shah Vs. Union of India through the Ministry of Home Affairs, New Delhi and Ors.1 During the pendency of the Petition, he is constrained to approach this Court since his younger daughter who has obtained Master's Degree in Architecture from the Royal Melbourne Institute of Technology. He has received an invitation for attending the Convocation Ceremony i.e., the Melbourne Graduation Ceremony scheduled on 17th December, 2025 and therefore he intends to visit Australia for attending the said ceremony. Thereafter, he intend to travel to New Zealand to meet his friends and relatives, who has cater to his daughter while she was persuading her education.
4) The Application contain the details of his travel including his tickets as well as the place where he is likely to reside. It is also categorically stated that the Applicant had approached the Special Court at CBI since there was also a Look Out Notice issued by the CBI but in the wake of the notice being recalled, this Order will not assist the Applicant as the LOC issued by the bank is still pending.
5) On hearing the learned Counsel for the Applicant and on 2024 SCC OnLine Bom 1995 2/3
perusal of the Application and since there is no appearance on behalf of the Bank of Baroda despite a notice being served upon it and an acknowledgment thereof being produced with an endorsement from Bank of Baroda of receiving a notice on 13/11/2025 and the same being taken on record, we deem it appropriate to grant the permission to travel abroad in terms of the schedule that is appended in terms of the itinerary for travel which is a part of the Application but with a specific undertaking that the Applicant shall return to India upon the period having been expired and similarly a copy of the itinerary along with an undertaking being forwarded about his return on due date, shall be tendered to the Commissioner, Bureau of Immigration, New Delhi i.e. Respondent No.
4 as well as on tendering the itinerary and a copy of the Affidavit before the Registrar of this Court before he leaves the country. 6) Subject to the aforesaid compliance being ensured, the Application is made an absolute in terms of prayer clause (b). The Applicant shall strictly follow the schedule as set out in the itinerary and return back to the country on 21/12/2025 on expiry of his tour and attaining the purpose for which he has sought the permission to travel abroad.
The Application is disposed of.
