Heard learned advocate for the Applicant. This is an application by the Appellant seeking deletion of Respondent No.3 and for permission to serve Respondent Nos. 1 society through R.P.A.D. by private notice. 2.

It is stated in the application that Respondent No.3 is found to be dead as per the bailiff report and it is further stated that Respondent Nos. 2 to 5 were not joined in their personal capacity. 3.

Considering the averments in the application, the Applicant is permitted to delete the Respondent No.3 at his own risk. Necessary amendment to be carried out within a period of 2 weeks from today. 4.

The Applicant is also permitted to serve Respondent No. 1 by private notice through R.P.A.D. Notice is made returnable on 21.01.2026. Necessary affidavit of service be filed before returnable date. 5.

Application is disposed of in above terms.
