This is an application for recalling the order dated 22nd December, 2021 passed by this Court.

By order dated 22nd December, 2021, the First Appeal was admitted and the appellant was directed to file private paper book within a period of six months form the date of order. It was further requested that in the event of default, the Appeal shall stand dismissed without further reference to the Court. Since the appellant could not prepare and e provide the paper book, the Appeal stood dismissed, as directed by this Court. 3.

The learned advocate for the appellant submits that the Appeal is already admitted and he has deposited the entire amount Digitally signed by RAJESHRI PRAKASH AHER Date:

13 IA 13406 OF 2025.DOC before the Maharashtra Motor Accident Claims Tribunal, Thane, and the claimant has also withdrawn 50% of the deposited amount. Therefore, on this background, the order needs to be recalled.

The learned advocate for the applicant/appellant further makes a request that further period of six months may be granted to him for preparing the private private paper book. 5.

Considering the fact that Appeal is already admitted and the amount is already deposited, it would be appropriate to grant an opportunity to the applicant/appellant to comply with the order by granting extension of six months for compliance of the order dated 22nd December, 2021 by recalling the said order. Accordingly order passed by this Court on 22nd December, 2021 stands recalled and the applicant is granted further six months time to furnish private paper book.

The delay of 3 years and 288 days in filing the application stands condoned.

In view of the abovmentioned observations, Interim Application stands disposed of.
