The Appeal is filed by Plaintiff challenging the impugned decree dated 29/09/2025 by which the suit for specific performance is dismissed. 3.

Learned Counsel for the Appellant invited this Court's attention to the order dated 24/09/2014 passed by the Trial Court by which the Respondents/Defendants were restrained from selling, transferring or creating 3rd party interest in the suit property till the disposal of the suit. Attention of the Court is also invited to the permission granted by the Trial Court under order dated 21/08/2025 for deposit of purported remaining amount of Rs.71,02,000/- in Court. Mr. Agrawal, learned Counsel for the Applicant/Appellant submits on instructions that this amount is accordingly deposited in the Court and undertakes to file receipt on record before the akn 1/2

In these circumstances, following order is passed in the Interim Application.

(a) Issue notice to the Respondents, returnable on 05/01/2026. Learned Counsel for the Respondent Nos. 1 and 2 waives service. (b) Till the next date, the interim injunction granted by the Trial Court on 24/09/2014 shall continue to operate between the parties. 6.

Reply may be filed within a period of three weeks from today with its copy served on the other side. Rejoinder, if any, to be filed within one week thereafter.
