The challenge in the present petition arises from an order passed by the Competent Authority rejecting the application seeking issuance of a corrigendum. The corrigendum sought pertained to the failure to mention the undivided right in the RG area. Such a modification cannot be construed as a procedural review. The issue is no longer res integra and is covered by the judgment of this Court in Kashish Park Realty Pvt. Ltd. & Anr. v. State of Maharashtra, (2021) 3 Mah LJ 778.

In that view of the matter, the petition challenging the rejection of the application for issuance of a corrigendum cannot be entertained.

However, it shall be open to the petitioner to challenge the original order passed under Section 11(3) of the Maharashtra Ownership Flats (Regulation of the Promotion of Construction, Sale, Management and Transfer) Act, 1963 by invoking the writ jurisdiction of this Court. In the event such a petition is filed, the same shall be considered on its own merits and in accordance with law.

The Writ Petition stands dismissed. There shall be no order as to costs.

In view of the disposal of the Writ Petition, the Interim Application does not survive and stands disposed of. (AMIT BORKAR, J.)
