This application is for restoration of the Appeal which came to be dismissed for not taking steps to serve Respondent Nos. 1 to 3.

Learned Counsel for the Applicant submits that since the notice was not served upon the Respondent Nos. 1 to 3, notice of present application be dispensed with.

Since, the Appeal came to be dismissed for non-service upon Respondent Nos. 1 to 3, notice of present application stands dispensed with.

Learned Counsel for the Applicant makes statement that he will take steps to serve Respondent Nos. 1 to 3 within a period of eight weeks today. Statement is accepted as undertaking. In view of the same, application stands allowed in terms of prayer clause (a) and (b) by condoning the delay. 5.

In case no steps are taken within the aforestated period, the Appeal shall stand dismissed against the Respondent Nos. 1 to 3 without reference to the Court.

Interim Application is disposed of.
