This application is taken out by the applicant/appellant to bring legal heir of respondent no.1 on record since respondent no.1 has passed away. The details of legal heirs are mentioned in the schedule at page 42 of the present application.

I have perused the application and since same has been filed, after the appellant was informed about the details of the legal heirs, there is no delay.

The addresses of the legal heirs are not available inspite of the efforts put in by the parties. Therefore, the applicant/appellant is directed to serve the newly substituted respondents by publishing the notice in one English

ppn 2 5.ia-38406.25.doc newspaper (Free Press Journal) and one Marathi newspaper (Sakal). The publication should be completed within eight weeks from today and affidavit to the same effect should be filed in this Court. 4.

In view of the above, interim application is allowed in terms of prayer clauses (a) and (b).

Amendment to be carried out within eight weeks from today and amended copy of the appeal to be served on the legal heirs of respondent no.1.
