Heard Ms. Amin, learned counsel for the Petitioner and Mr. Shaikh, learned counsel for the Intervenor who has filed the Interim Application. This Court has passed the earlier order dated 17 December 2025 which reads thus:- "1.

None appears for the Petitioner. These are proceedings pertaining to the year 2016. The Petitioner is expected to be diligent in pursuing such matters particularly when the matters are pending in this Court since long time. To grant an opportunity to the Petitioner to appear and/or represent himself before the Court, stand over to

18 December 2025 under the caption for Directions/Dismissal.

It is made clear that if despite such opportunity none appears for the Petitioner and/or the Petitioner is not represented, the Court shall endeavour to pass appropriate orders on the said date."

Pursuant to the above, Ms. Amin enters her appearance and states that she would be henceforth appearing and representing the Petitioner.

On perusal of the record it appears that on 29 February 2016 by an order of this Court it was directed that an attempt would be made to dispose of this proceedings finally at the stage of admission. From such time, the proceedings are pending on the file of this Court. Today, the Court is ready and willing to hear the parties and pass appropriate orders including disposal of the Petition as indicated in the order dated 29 February 2016. 4.

Further, Ms. Amin has expressed her inability to proceed with the matter. She would urge that the matter be kept in the first week of January as in the coming week is also she is not available due to personal reasons. 5.

As this matter is of the year 2016 and pending since then the Court is not inclined to grant an adjournment. However, for the reasons expressed above and in the interest of justice and by way of last chance and to the Petitioner, this Court reluctantly adjourns the proceedings to 9 January 2026.

The parties are expected to proceed with the matter on the said date, subject to time constraints when the Court shall hear the parties and pass appropriate orders. 7.

The Intervention Application, a copy of which is furnished to the Petitioner, can also be heard and decided on its own merits.
