Heard Mr.Kishor Redekar, learned counsel appearing for the Petitioner. The Petitioner is basically assailing the rejection of his nomination on the ground that the same has been improperly rejected. The election of the society is fixed on 22nd December 2025 and the last date of acceptance of nomination is over. Notwithstanding the same, the Petitioner is seeking a direction from the Court to accept his nomination.

Considering the facts and circumstances of the case, we are of the prima facie view that the dispute raised in the Writ Petition lies in the realm of an election dispute. However, after hearing the submissions of learned counsel for the Petitioner, we are also of the view that there are issues of substance raised in this Petition, which would call for determination by this Court.

Issue notice returnable on 5th February 2026. 4.

Learned Addl.G.P. waives notice for Respondent No.7 and learned Advocate Mrs.S.V.Bharucha waives notice for Respondent No.6. Court notice be issued to the remaining Respondents. 5.

Having regard to the facts and circumstances of the case and also on account of the fact that the Petitioner is primarily assailing rejection of his nomination on the ground that the same has improperly rejected and also in view of the fact that the last date of submission of nomination for elections of the society scheduled on 22nd December 2025 is already over, we are not inclined to pass any ad-interim order in this case, save and except observing that the results of the election shall be subject to the further order that may be passed in this Writ Petition.
