Heard learned Counsel for the Applicant/Appellant. 2.
This is an Application for bringing legal heirs of deceased Respondent No. 3-Dhanavati Ramesh Thakur on record. It appears from the death certificate produced on record that the deceased has expired in September 2021 during the pendency of the Suit itself, however, the suit proceeded without legal heirs being brought on record. The proposed names and details of the legal heirs are provided in the schedule of amendment.

Learned Counsel appearing for the Respondent Nos. 1 to 5 states on instructions that he can appear for the proposed legal heirs - Respondent Nos. 3(a) and 3(b). He undertakes to file Vakalatnama on behalf of the Respondent Nos. 1 to 5 including the proposed Respondent Nos. 3(a) and 3(b) within a akn

Considering the averments in the Application and admitted position that parties are closely related, in as much as they are real siblings, sufficient cause is made out for condonation of delay.

Accordingly, the Application is allowed. Delay is condoned. The Applicant is permitted to bring legal heirs of the deceased Respondent No. 3 on record. Necessary amendment to be carried out within a period of two weeks from today.
