The Applicant seeks modification of Condition No. 3 of order dated 11th March, 2024 passed by the Special Judge (POCSO), Greater Bombay. The Condition No. 3 reads thus: "After filing of charge-sheet, the accused shall attend Santacruz police station once in a month particularly on Saturday between 09:00 a.m. to 10:00 a.m. and when called by the Investigating Officer, till the trial is completed."

Mr. Viral Rathod, learned Counsel appearing for the Applicant submits that the Applicant has attended the Police Station regularly and diligently as per the condition imposed in 1/3

the bail order for the past 2 years, save and except on one occasion when he was in some personal difficulty. As on date, the charges are not framed. He also submits that the Applicant is gainfully engaged with LIC and he is required to travel throughout the State of Maharashtra in course of his duties and hence, it is difficult for him to attend the Police Station on Saturday of every month. Hence, he has made the present Application.

I have heard Mr. Viral Rathod and Ms. Megha Bajoria, learned A.P.P. for the State, and have also gone through the said bail order and the papers with the assistance of the learned Counsel.

I am of the view that the interest of justice is subserved if the said Condition No. 3 is modified to the extent that the Applicant shall attend the Police Station as and when called by the Investigating Officer during the pendency of the Trial. 5.

Rest of the order remains as it is.

The Interim Application is partly allowed and disposed of accordingly.
