Heard learned Advocate for the applicant. He submitted that there is a compromise between the applicant and respondent No.2 out of Court and for that purpose there is an affidavit of respondent No.2. 2.
In fact, we are not happy with the procedure that has been adopted. If there is compromise and there would have been an affidavit, respondent No.2 would have filed it on his own. There is no such practice that applicant should get the affidavit of respondent No.2 and file it on record along with application. 3.
With these observations, we issue notice to the respondents. Learned A.P.P. waives service of notice for respondent No.1-State.
