DATE : 07.03.2026 Present application is preferred by the applicant under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023 contending that applicant and non-applicant No.1 are husband and wife. Their marriage was solemnized on 24.04.2011. The matrimonial relationship between applicant and his wife was strained and wife of the applicant left the matrimonial house on 19.02.2023. Thereafter applicant sent notice for dissolution of marriage and instituted petition before the Family Court Akola bearing Petition No.102/2023 now transferred to the Family Court Yavatmal by order of this Court in Miscellaneous Application No.576/2023 bearing No.A/121/2025. Thereafter petition filed by the non-applicant No.1 and her minor daughter bearing No.D/11/2023 which is also pending before the Family Court, Yavatmal.

Non-applicant No.1 filed proceedings for grant of maintenance under the provisions of 125 of the Code of
Criminal Procedure is also pending before the Family Court Yavatmal bearing E/43/2023. Now, the proceeding under the provisions of Protection Of Women From Domestic Violence Act against the present applicant and his family members is filed by the non-applicants which is pending on the file of 4th Judicial Magistrate First Class, Yavatmal. The father of the applicant namely Gurucharansingh Bedi was also party to the said proceeding. But he subsequently succumbed to the death. Thus, four proceedings are pending between the parties. Out of which two proceedings are filed by the applicant i.e. Divorce petition bearing A-Petition No.121/2025 and the custody petition for custody of the minor daughter bearing Petition No.D/11/2023 pending before the Family Court Yavatmal.
The maintenance petition is also pending before the Family Court Yavatmal filed by non-applicants. Now, Domestic Violence Petition is pending at Judicial Magistrate First Class Yavatmal and therefore, this application is filed for transfer the said proceeding also to the Family Court Yavatmal to avoid the multiplicity of the proceedings.

Learned counsel for the non-applicants has no objection for the same.

Heard learned counsel for the applicant as well as learned counsel for the non-applicants.

Considering the reasons mentioned in the application that several proceedings are filed and three proceedings are already pending before the Family Court, Yavatmal. Only
D.V. Proceeding is pending before Judicial Magistrate First Class, Yavatmal to avoid the multiplicity of the proceeding and different opinions the application deserves to be allowed.

Hence I proceed to pass following order:- (i) The application is allowed.
(ii)The D.V. Proceeding No.39/2023 pending in the court of 4th Judicial Magistrate First Class, Yavatmal is hereby transferred to the Family Court Yavatmal. 7.
The application is disposed of.
