Vide order dated 22.09.2025, this Court passed order which reads thus:
The applicant is directed to deposit 75% of the arrears amount in this Court within six weeks, failing which the application shall stand dismissed.

Mr. G. L. Gujar, Learned Counsel for the respondents would urge that the petitioner has not complied with the order passed by this Court on 22.09.2025.

Mr. S. S. Kulkarni a/w Mr. M. D. Deshpande h/f Mr. K. B. Suryawanshi, learned Counsel for the petitioner could not counter this statement made by the learned Counsel for the respondents. He argues that even the respondent has not filed any reply in the matter. He tries to justify failure of the petitioner to deposit the amount directed by this Court on the ground that the respondents have not filed reply. 4.
The explanation is absurd one. It demonstrates petitioner's conduct.

This Court has already observed that failure on behalf of the petitioner to deposit the 75% of arrears amount in this Court within six weeks, the application shall stand dismissed. Petitioner has not complied order of this Court. This Court is bound by the earlier order dated 22.09.2025.

In view of the fact that the petitioner has not complied with the order till this date, the application stands dismissed. ( AJIT B. KADETHANKAR, J. ) Rushikesh/2026
