Heard the learned Counsel for the parties.

This is an application for transfer of PWDVA Application No.125 of 2024 filed under the Protection of Women from Domestic Violence Act, 2005, pending on the file of the Chief Judicial Magistrate, Nashik to the Family Court at Nashik, where a Petition for dissolution of marriage being PA No.344 of 2025 (Old No.500 of 2024) is pending.

The said Petition for dissolution of marriage i.e. PA No.500 of 2024 was initially filed by the Applicant before the Family Court at Pune. By a common order dated 28 February 2025 in MCA Nos.339 of 2024 and 264 of 2024, this Court transferred the said Petition No.500 of 2024 from the Family Court at Pune to the Family Court at Nashik.

In this backdrop, it would be expedient in the interest of justice that the proceeding under the Protection of Women from Domestic Violence Act, 2005 being PWDVA No.125 of 2024 is also transferred to the Family Court at Nashik as it obviates the duplication of adjudication process and evidence. Simultaneous hearing of both the proceedings by the Family Court, may also promote the cause of justice.

Hence, the Application stands allowed.

PWDVA No.125 of 2024 pending on the file of Chief Judicial Magistrate, Nashik stands transferred to the Family Court at Nashik, for hearing and disposal in accordance with law.

The learned Chief Judicial Magistrate, Nashik shall transfer the record and proceedings in PWDVA No.125 of 2024 with such dispatch that it reaches the Family Court at Nashik within a period of three weeks from the date of communication of this order.

Application stands disposed.
