This matter is appearing in due orders category as the respondent/husband in Miscellaneous Application No.E-181 of 2019 before Family Court, Aurangabad has not caused his appearance. However, learned counsel for the applicant has demonstrated from record that respondent was informed the pendency of these proceedings and he is dodging the regular process of the Court. He has deliberately not caused appearance either before Family Court at Aurangabad as well as Judicial Magistrate First Class, Pune in Criminal PWDVA No.1238 of 2022. However, it is informed that respondent's real brother and brother's wife are appearing before Criminal Court at Pune.

It reveals from record that the respondent has left India and residing at address in Stamford, United States. On earlier occasion, he was served and service report was filed on

19-Cri.Appln.320-25.odt 15.10.2024 through ABC legal private entity for effecting the court services abroad. Despite of that, no appearance was caused by him.

When respondent was tried to be served on the address shown in the proceedings of Ardhapur, it was informed that he was not found on the given address and he left the place. There is reason to believe that respondent is aware of the proceedings. I deem it appropriate to grant one more opportunity to the respondent to appear before this Court. 4.

Meantime, it would be opened for the applicant to place minutes of today's order before competent Court at Pune which is seized of PWDVA No.1238 of 2022 and bring it to the notice of the Presiding Officer to enable brother or brother's wife of the respondent or their counsel, the status of the present proceedings and the notified date of 07.05.2025. I hope that the Presiding Officer shall make endeavour to fix the matter before 07.05.2025 and apprise the concerned parties. 5.

List this matter for final disposal on 07.05.2025. (SHAILESH P. BRAHME, J.) ...
