Heard Mr. Bharat Gandhi, learned Counsel appearing for the Applicant and Mr. Mangaonkar, learned APP appearing for the Respondent No.1-State.

By the present Criminal Application filed under Section 483(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Applicant is seeking cancellation of Anticipatory Bail granted to the Respondent No.2 by order dated 3rd July 2025 passed by the learned Additional Sessions Judge-5, Nashik in Bail Application No.1075 of 2025.

It is the main submission of Mr. Bharat Gandhi, learned Counsel appearing for the Applicant that on the false promise of marriage, the Respondent No.2 kept sexual relationship with the Applicant and therefore, prima facie the material on record shows that the Respondent No.2 is involved in serious crime under Section 69 of the Bharatiya Nyaya Sanhita, 2023. He points out the FIR and more particularly, the part where it is stated by the Applicant that in February 2025 when she visited the residence of the Respondent No.2, the Respondent No.2 has specifically stated that he is not interested in marrying the Applicant. Mr. Bharat Gandhi, learned Counsel therefore, submitted that this is a case where by giving false promise of marriage, the Respondent No.2 kept sexual relationship with the Applicant and thereafter refused to marry her.

He further submits that subsequent to the filing of this Criminal Application, NC has been lodged on 4th October 2025, wherein threat is given to the Applicant that if the Applicant fails to withdraw the case, then after Diwali, the Respondent No.2 would take some action.

Perusal of the record shows that the learned Additional Sessions Judge-5, Nashik by order dated 3rd July 2025 while

granting anticipatory bail to the Respondent No.2 has observed that the parents of the Applicant i.e. the First Informant refused the said marriage proposal on the ground that the Applicant belongs to the Brahmin caste and the Respondent No.2 belongs to the Mali caste. In fact, the learned Additional Sessions Judge has recorded the submissions made on behalf of the learned Advocate of the Applicant i.e. First Informant to the effect that the First Informant is in relationship with the Respondent No.2 and desires to marry him and parents conversation is not binding on her. The learned Additional Sessions Judge-5, Nashik has observed that both, the Applicant and the Respondent No.2, were friendly on social media and thereafter, they were in relationship for 3 years. However, as the parents of the Applicant have not consented for marriage, the Respondent No.2 got engaged to another girl. Therefore, the FIR was lodged. Thus, it cannot be said that the order granting anticipatory bail is perverse order. 5.

There is nothing on record to show that any of the conditions have been violated by the Respondent No.2. It is required to be noted that the order granting anticipatory bail is dated 3rd July 2025 and the present Criminal Application has been

lodged on 7th August 2025. The above referred NC has been thereafter lodged on 4th October 2025. It is required to be noted that the NC has been lodged on 4th October 2025 concerning the incident which has taken place on 12th September 2025 i.e. after almost about 22 days. Thus, the NC which has been lodged belatedly, cannot be the basis for cancellation of anticipatory bail. 6.

Accordingly, the Criminal Application is dismissed. 7.

However, liberty is granted to the Applicant to file a fresh Criminal Application, if the Respondent No.2 violates any of the conditions imposed by the order dated 3rd July 2025 passed by the learned Additional Sessions Judge-5, Nashik in Bail Application No.1075 of 2025.
