The Applicant is an accused in Criminal Case No.551 of 2024 for the offence punishable under Section 498-A of the Indian Penal Code pending on the file of Judicial Magistrate First Class, Dhule. By this Application under Section 447 of the Bharatiya Nyaya Sanhita, 2023, the Applicant seeks transfer of the said case from the court of Judicial Magistrate First Class, Dhule to the court of Judicial Magistrate First Class, Nashik. 2.

I have heard Learned Counsel for the Applicant. 3.

The transfer is sought on the ground that the original complainant is residing in Nashik. It is submitted that some of the witnesses are from Nashik. The Respondent/Original Complainant, who is present in the court, disputes the said position.

Be that as it may, it appears that Charge is already framed in the matter.

In that view of the matter, I am not inclined to entertain the present Application. The present Criminal Application is thus rejected. 6.

However, considering the fact that matter arises out of matrimonial dispute, the trial court shall make an endeavour to conclude the trial as early as possible.
