By way of this Application, the Applicant seeks relaxation of modified condition modified vide order dated 9th September, 2020, whereby the Applicant was exempted from attending the office of EOW CB-CID - Unit-I, Mumbai till December, 2020. Thereafter, from January, 2021 the Applicant was directed to report to the Investigating Officer, EOW, UnitI, every alternate month i.e. on the 15th day of that particular month.

Heard Mr. Madhusudan Pareek, learned counsel for the Applicant and Ms. Gauri Rao, learned APP representing the State.

Mr. Pareek, submits that the Applicant is 72 years of age. The charge-sheet was filed only in 2017 and till date charges have not been framed. Ms. Rao, submits that the charges are not framed because there are in all eleven accused and alternatively the accused have made application seeking discharge and the Trial Court is seized with hearing the discharge applications.

Considering that the Applicant is a resident of Hyderabad and having regard to his old age, the Applicant is directed to report to the nearest police station in Hyderabad on every 15th day of alternate month.

Rest of the conditions shall remain as it is. 6.

Application is partly allowed in the aforesaid terms and is disposed of.
