IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 42 CRIMINAL APPLICATION NO. 611 OF 2025 SACHIN VINAYAKRAO KHILLARE ....Applicant

VERSUS

PALLAVI SACHIN KHILLARE ALIAS PALLAVI RAMCHANDRA DAWANE .....Respondent Mr. K. P. Rodge, Advocate for the applicant Mrs. A. S. Deshmukh, APP for the respondents/State Adv. Pathan Ziya, for the respondent CORAM : KISHORE C. SANT, J.

DATE : 10th JUNE, 2025 P. C.

1.

Heard.

2.

This application is for transfer of the proceeding under Section 125 pending before the learned Family Court, Nanded to the learned Family Court at Parbhani on medical ground.

3.

It is the case of the applicant-husband that he is

(2) suffering from Right Hip Avascular Necrosis and he is also advised not to travel. Thus, the applicant is not in a position to travel to attend the dates of court. He has produced on record the certificates to show he is advised not to travel. 4.

The learned advocate for the applicant Mr. Rodge, strenuously argued that this is a fit case where the proceedings need to be transferred.

5.

Adv. Pathan, for the respondent opposes the application. He submits that this court has already passed an order in Misc. Civil Application No. 184/2024 dated 10-03-2025 transferring the civil proceeding from the court at Parbhani to the court at Nanded. He further submits that the respondentwife is staying with three minor children. It is, therefore, difficult for her to come to Parbhani for attending the dates. 6.

Having considered the matter and earlier order passed by this court, this court finds that following order would

(3) meet ends of justice.

ORDER

a] The application stands rejected.

b] However, the applicant to make request to appear through video conference. If such request is made, the court at Nanded to entertain such request and allow the applicant to appear through video conference.

c] The wife shall not seek unnecessary adjournment. If this court finds that unnecessarily adjournment is sought, the court may pass order compensating the respondent on such date.

d] With this, the application stands disposed off. [KISHORE C. SANT, J.] VishalK/42criapln611.25
