We have perused the FIR No.98/2023, registered on 07.05.2023, with the Dindrud Police Station, District Beed. It is contended that the FIR is a counter to an earlier FIR No.92/2023, registered on 30.04.2023, with the same Police Station by the Applicants. 3.

We expressed our disinclination to the extent of Applicant Nos.2 and 4, namely, Avaduth and Rameshwar, considering the contents of the FIR. The learned Advocate for the Applicants submits that Applicant Nos.2 and 4 would not press this Application and seeks leave

to withdraw. In view of the same, the Application is disposed off as withdrawn as regards Applicant Nos.2 and 4.

We find that the Application put forth by Applicant No.1/ Sarjerao and by Applicant No.3 / Bhagyashree, deserves to be considered.

Issue notice to the Respondents, returnable on 22.04.2025. The learned APP waives service of notice on behalf of Respondent No.1. 6.

Spare copy of the Application paperbook shall be supplied on or before 01.04.2025 for effecting the service upon Respondent No.2, failing which, the Application shall stand dismissed without reference to the Court, on 02.04.2025.

The office objections, if any, to be removed on or before 03.04.2025, failing which, this Application would stand dismissed without reference to the Court, on 04.04.2025. 8.

Since the Charge-sheet has been filed, we direct the learned Trial Court to refrain from framing the Charge as against Applicant No.1/ Sarjerao and Applicant No.3/Bhagyashree, respectively.
