Heard learned Advocates for the parties. With their assistance, I have perused the above Criminal Application filed in the Criminal Revision Application. Such application is filed by the Applicant (Original Respondent) for withdrawing an amount of Rs. 45,000/- deposited by the Respondent (Revision Applicant) in the Court.

My attention is drawn by the parties to an order dated 08 August 2022. By the said order, the sentence awarded by the Trial Court qua the Applicant was suspended till the disposal of the Revision Application. The suspension of the sentence was subject

to deposit of Rs. 45,000/- by the Respondent (Revision Applicant) in this Court within a period of three weeks from today. The Criminal Application filed for suspension of sentence was accordingly disposed of. 3.

Pursuant to above order, the Court by another order dated 20 December 2022 noted that the learned Advocate for the Respondent (Revision Applicant) is ready and willing to deposit a sum of Rs. 45,000/- with the Court. The parties point out that such deposit has been duly made, as directed by the Court, on 10 January 2023.

Today, the Applicant (Original Respondent) would pray for withdrawal of the said amount. The case for such withdrawal has been enumerated in the application filed by the Applicant (Original Respondent). I have perused the said application. The learned Advocate for the Respondent (Revision Applicant) would submit that he has no objection for withdrawal of such amount.

In the facts and circumstances narrated above, Applicant (Original Respondent) is permitted to

withdraw the amount of Rs. 45,000/-, which is deposited with this Court. He may be permitted to withdraw such amount within a period of one week from today subject to the Applicant (Original Respondent) complying with the procedures in this regard.

In terms of the above, nothing survives in the above Criminal Application No. 1625/2025, it is disposed of accordingly.

The parties submit that the settlement talks are on going between the parties. The parties shall inform the Court on the status of such settlement on or before adjourned date of hearing.

By consent of the parties, list the proceedings on 17 July 2025.
