Heard the learned counsel for the applicants, the learned APP for the respondents-State and Mr. A.K. Bhosle, learned advocate assisting APP. 2.
The applicants have approached this Court apprehending arrest in connection with Crime No. 361/2025 dated 16.4.2025 registered with MIDC Waluj Police Station, District Aurangabad for the offence punishable under sections 109, 115(2), 189(2), 191(1), 191(3), 190 of B.N.S., 2023, section 4/25 of Arms Act and section 135 of Maharashtra Police Act. 3.
The learned counsel for the applicants submits that applicants Yogesh Ramchandra Kasure and Rajendra Udaybhan Kasure in ABA No. 746/2025 and Narendra Shamlal Kasure in ABA No. 743/2025 are admitted in hospital
and therefore, interim protection may be granted to them. The learned APP on instruction has not disputed the fact that the above applicants are admitted in hospital. The learned counsel assisting APP also submits that even the informant is also injured.

Considering the above, interim protection can be granted to the applicants Yogesh Ramchandra Kasure and Rajendra Udaybhan Kasure in ABA No. 746/2025 and Narendra Shamlal Kasure in ABA No. 743/2025. It is made clear that this interim relief is not granted on merits and the matter will be considered on merits on the next date. 5.
In the meanwhile, there shall be interim order in the following terms :- A] Till the next date, in the event the applicants Yogesh Ramchandra Kasure and Rajendra Udaybhan Kasure in ABA No. 746/2025 and Narendra Shamlal Kasure in ABA No. 743/2025 are arrested in connection with Crime No. 361/2025 dated 16.4.2025 registered with MIDC Waluj Police Station, District Aurangabad for the offence punishable under sections 109, 115(2), 189(2), 191(1), 191(3), 190 of B.N.S., 2023, section 4/25 of Arms Act and section 135 of Maharashtra Police Act, they shall be released on bail on furnishing PR bond of Rs.20,000/- each with one or two sureties in the like amount.
B] The above applicants shall remain present before the investigating officer as and when required by the investigating officer. C] The above applicants shall co-operate with the investigation, including producing all documents in his possession, as may be demanded by the investigating officer.
D] The above applicants shall not influence the informant, witnesses or any person concerned with the case and he shall not tamper with the evidence.

Needless to say, violation of any of the aforesaid conditions may result in this order being cancelled.

List on 10.6.2025. Interim protection granted today to continue till then only.
8.
