The learned counsel for the applicant points out order dated 04.03.2025 in the case of co-accused Rameshwar Asaram Narwade bearing Bail Application No.2294 of 2024, as the applicant therein has been granted bail on the ground of delay in trial. The present applicant is also a co-accused in the same crime. The applicant is aged 71 years. He also points out the letter of the District Legal Services Authority; pointing out that under the scheme made by the National Legal Services Authority, the old age applicants / accused cases are to be taken on priority basis for consideration of bail.

In the instant case, the co-accused has already been granted bail on the ground of delay in trial.

The learned APP, so also, the learned counsel for the assist to public prosecutor to make submissions, why the applicant should not be released on bail on the same ground.
