Heard the learned counsel for the applicant and the learned counsel for the respondents, at length. 2.

By the present application under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant / husband is seeking transfer of proceeding bearing PWDV No.61 of 2023 from the file of learned Judicial Magistrate, First Class, Amalner to the file of learned Judicial Magistrate, First Class, Pune, on the ground that he and the non-applicants are residing within the jurisdiction of the learned Judicial Magistrate, First Class, Pune.

Ms. Deepali Patil, the learned counsel appearing for the non-applicants, on instructions, made a statement that the nonapplicants have no objection for transfer of the proceeding bearing PWDV No.61 of 2023 from the file of learned Judicial Magistrate, First Class, Amalner to the file of learned Judicial Magistrate, First Class, Pune.

In view of above, the present application is allowed. 5.

The proceeding bearing PWDV No.61 of 2023 is hereby withdrawn from the file of learned Judicial Magistrate, First Class, Amalner and it is transferred to the file of learned Judicial Magistrate, First Class, Pune, for trial and decision.

This order be communicated to both the Courts. 7.

The fees of the appointed counsel Ms Deepali Patil, shall be quantified as per rules and be paid by the High Court Legal Services Sub-Committee, Aurangabad.
