Mr. Prafullasing H. Patil, learned counsel appears suo-moto for respondent No.2.

Though the learned counsel for the applicant and the learned counsel for respondent No.2 submit that the parties have settled the matter out of the Court, the fact to be born in mind, is that the FIR was lodged in 2009 and it appears that as against co-accused the trial went on and it is stated that they have been acquitted. The question remains regarding the conduct of the present applicant. It is required to be seen as to whether he was absconding and which steps were taken for securing his presence.

Issue notice to the respondents.
