Since the offence against the accused is under the provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, the inclusion of victim or his legal heirs is essential in this matter.

Learned Counsel for the Applicant submits that the deceased is survived by his father and the name of his father will be included as Respondent.

As such, leave is granted to add the name of father of deceased as Respondent No.2 within one week in the application as well as in main appeal.

After such amendment is carried out, issue notice to Respondent No.2 returnable within two weeks thereafter. 5.

Learned APP is requested to direct the concerned police station about the service of notice of Respondent No.2. 6.
