The affidavit is filed by the present Investigating Officer in pursuance to the order dated 18.12.2025.

The learned Senior Counsel for the Applicants submits that although the affidavit has been filed in pursuance of the order passed by this Court, it has been filed by the present Investigating Officer and not by the Investigating Officer who had actually obtained the CCTV footage during the course of investigation. 3.

The perusal of the documents produced on record shows that the then Investigating Officer had obtained the CCTV footage

2 926.ABA-1534-2025.doc during the course of investigation. It would therefore be appropriate to direct the said Investigating Officer to file an affidavit as directed by this Court vide order dated 18.12.2025.

In view of the above, the then Investigating Officer, namely Mr. S.D. Narke of Pathri Police Station, Parbhani, is directed to file an affidavit within a period of two weeks from today. A copy of the said affidavit shall be furnished in advance to the learned Counsel for the Applicants as well as to the assisting Counsel. 5.

Stand over to 10.02.2026.
