By the instant application, the applicant seeks relaxation of conditions imposed upon him by this Court, in clause II(b) and (c) of the order dated 23.04.2025, in B.A.No.646 of 2025, which read thus;
"[b] The applicant shall not leave the area of jurisdiction of the concerned police station till conclusion of trial.
[c] The applicant shall attend the concerned police station twice in every week i.e. on every Monday and Thursday between 11.00 a.m. to 02.00 p.m. till framing of charge and thereafter, shall regularly attend each and every effective date before the trial court."

Learned counsel for the applicant submits that the applicant has duly complied with the aforesaid conditions and has not committed any breach thereof. It is further submitted that the applicant is a public servant, working as Assistant Accounts Officer under Zilla Parishad, Parbhani and there is likelihood of his reinstatement at some other place and the stipulation is impeding to his service career. Hence, prayed to allow the application. 3.
Learned A.P.P. has opposed the application. However, fairly conceded that the aforesaid conditions can be modified in the interest of justice.

Upon hearing the learned counsel for the applicant and the learned A.P.P., I am of the considered view that the aforesaid conditions can be relaxed since no prejudice would be caused to the prosecution. Accordingly, the application deserves to be allowed.

Resultantly, the criminal application is allowed in terms of prayer clause "B", subject to condition that the applicant shall attend Police Station of his place of posting, on every Saturday. [SACHIN S. DESHMUKH] JUDGE rrd
