The Applicant seeks quashment of FIR No. 0505/2025, registered with Bhagyanagar Police Station, District Nanded for the offence punishable under Sections 75(1) and 78(1) of Bhartiya Nyaya Sanhita, 2023.

Learned Advocate appearing for Applicant took this Court through the contents of the FIR. A reading of the FIR shows that there are specific allegations against the Applicant that on 06.09.2025 he stalked informant while informant was proceeding 919 APPLN 4044.2025.odt

on her two wheeler. It is further alleged that he caught hold her hand with a bad intention. Eventually, an offence came to be registered against the Applicant.

It is the contention of the Applicant that he has been falsely implicated and he has also lodged a complaint against the informant and her companions at the police station. According to the Applicant, present complaint is by way of counter blast. However, the aforesaid contention cannot be considered at this stage, as it would be a matter of trial. The contents of the FIR are sufficient to make out a prima facie case for alleged offences against Applicant.

In that view of the matter, no case is made out for exercise of powers under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023. Hence, Application stands rejected. (S. G. CHAPALGAONKAR, J.) ssp 919 APPLN 4044.2025.odt
