The present Application is filed under Section 407 of the Code of Criminal Procedure, seeking transfer of Criminal Miscellaneous Application No.450 of 2023, pending before the learned Judicial Magistrate First Class, Shirpur, District Dhule, to the learned Family Court, Jalgaon. 2.

It is pertinent to note that learned counsel for Respondent Nos. 1 and 2, who are the original Applicants in Criminal Miscellaneous Application No.450 of 2023, has stated that they have no objection to the transfer of the said criminal proceedings from Shirpur to Jalgaon, as prayed. 3.

The statement made by the learned counsel for Respondent Nos. 1 and 2 is accepted.

In view of the above, the Application is allowed and the Criminal Miscellaneous Application No.450 of 2023, pending before the Shrikant Malani

929.APPLN.4182.2025.odt learned Judicial Magistrate First Class, Shirpur, Dist. Dhule is hereby transferred to the learned Judicial Magistrate First Class, Jalgaon, as per the request of the Learned counsel for the respondents Nos. 1 and 2. 5.

It appears from the record that the said Application has been pending before the learned Magistrate since 01st February 2024. As per the mandate in Section 12(5) of the Protection of Women from Domestic Violence Act, 2005, such an Application must be disposed of within 60 days of the first hearing.

In view thereof, the learned Magistrate is directed to endeavour to dispose of the proceeding as expeditiously as possible. The Application is disposed of. Inform the concerned Courts accordingly. (ABHAY J. MANTRI, J.) Shrikant Malani
