Applicant is seeking relaxation of condition imposed by order dated 14.08.2025 passed in Criminal Bail Application No. 1518 of 2025, prohibiting him from entering the Ahilyanagar district during pendency of trial except for attending the dates of the trial. 3.

The condition is sought to be relaxed on the ground of illhealth of wife of the applicant. It is submitted that she is bed-ridden and there is nobody to look after her. She is partially paralyzed and required to be treated from neuro surgeon and cardiologist. On earlier

2 4314 - 2025 occasion, applicant was released on temporary bail. He is stated to have scrupulously followed the conditions.

Application is contested by the respondents on the ground that no cogent material is placed on record to show ill-health of the spouse and to relax the condition.

A photocopy is placed on record of FIR bearing C.R. No. 584 of 2025 registered on 23.06.2025 against applicant and his 70 to 80 companions, who had taken out a rally after releasing him on temporary bail.

The applicant is involved in a serious offence bearing C.R. No. 478 of 2020 punishable under section 302, 120-B r/w. 34 of the IPC . He was granted bail vide order dated 14.08.2025 on the ground of illness of his wife. He was permitted to be released on temporary bail for four (4) weeks, to enable him to make arrangements for medical treatment of his wife. Now he is seeking relaxation of the condition.

It is brought on record that after enlargement on bail in pursuance of order dated 18.06.2025, he had taken out a rally on 23.06.2025 with 70 - 80 persons. The mob was gathered to receive him and his release was further celebrated by firecrackers. The audio and video clips were circulated on social platform. The manner in

3 4314 - 2025 which the earlier order was implemented, is objectionable and it creates doubt about the real purport for securing bail on earlier occasion.

In the present matter, no case is made out as to why the condition needs to be relaxed. The illness of his wife can be taken care of without entering Ahilyanagar district. It would be open for the applicant to take his wife for the treatment at any place other than Ahilyanagar district.

I do not find any substance in the Application. Criminal Application is rejected.
