By this application applicant seeks quashment of FIR in Crime No.14/2022 and consequential proceedings in Regular Criminal Case No.461/2023 for offence punishable under Section 420 of Indian Penal Code alongwith Section 66(D) of Information Technology Act, 2000.

The investigation was set in motion on the basis of information given by Chirag Sanjay Shaha. In nutshell, it is allegation in FIR that informant was induced to deposit amount under pretext of exponential returns. Accordingly, he transferred amount in various account numbers, as were provided. Accordingly, he has deposited an amount of Rs.44,18,351/- towards investment. He was again induced to make further deposits falsely showing that his investments are earning expected returns. Lastly, informant came to know that he has been cheated by giving false assurance. The contents of FIR itself shows that amount of

Prima facie, evidence in charge-sheet discloses involvement of applicant in commission of offence. Although learned Advocate appearing for applicant endeavours to contend that the applicant was not aware of amount deposited in his account, on a specific query by this Court, he informed that amount received in applicant's account has been personally utilized by him. 4.

In that view of matter, triable case is made out against applicant. There is no ground to exercise inherent powers and quash proceeding against applicant. In result, Criminal Application stands rejected.
