Criminal Application No. 4850 of 2025 is for condonation of delay of 363 days caused in preferring appeal against the judgment and order of conviction dated 16.10.2024 passed by learned Special Judge, Jalna in Special Case No. 210 of 2023.

Learned counsel for the applicant submits that, applicant is in jail. That, there is no elderly person to take steps to file appeal within limitation, resulting into delay which is not intentional. 4.
Learned APP has also no objection to condone the delay as it is a jail appeal.

In view of the above, Criminal Application No. 4850 of 2025 is allowed. Delay stands condoned. Registry to register the appeal. 6.
Issue notice to the respondents in Criminal Application for suspension of sentence as well as the Criminal Appeal. Learned APP waives notice for respondent no.1-State. Learned counsel Ms. Patil h/f learned counsel Mr. Salunke waives notice for respondent no.2. 7.
