By the present application, the applicant invoked the jurisdiction of this Court under section 227 of the Constitution of India read with section 482 of the Criminal Procedure Code and challenged the order dated 23.09.2024 passed below Exh. 50 in Sessions Case No. 18 of 2021 by the learned Additional sessions Judge, Latur.

Since, the applicant has invoked powers of this Court under Article 227 of the Constitution read with Section 482 of the Cr.P.C., therefore, this application could have been registered as Writ Petition, however, the office registered the matter as Criminal Application.

In view of the above, the office is directed to re-register

912appln91-25 the present matter as Criminal Writ Petition by de-registration of Criminal Application No.91 of 2025.

After registration of the matter as Criminal Writ Petition, issue notice to the Respondents, made returnable on 07.02.2025. Learned APP waives service of notice on behalf of the Respondent State.

In the meantime, the applicant shall remove all office objections, failing which, the matter shall stand dismissed without reference to the Court.
