In this Writ Petition, the order passed by the competent authority attaching the assets of the petitioner in exercise of power under Section 4 of 'The Maharashtra Protection of Interest of Depositors ( In Financial Establishment) Act, 1999' (for short 'the MPID Act') is under challenge. This Court vide order dated 23.12.2025 passed in Writ Petition No.11934 of 2021 of which one of us (Shri Justice Abasaheb D. Shinde) was a member, has taken a view that the aforesaid order can be challenged as per the provisions under Sections 6 and 7 of the Act by approaching the Designated Court. The Designated Court is very much available at District Aurangabad. Learned counsel for the petitioner therefore, proposes to avail the said remedy. 2.

In view of the same, the Criminal Writ Petition stands disposed of with a liberty to approach the Designated Court for appropriate relief.

We make it clear that the time spent in prosecuting this Writ Petition shall be excluded while computing the period of limitation, if any, required for approaching the Designated Court under the MPID Act.
