IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 975 CRIMINAL WRIT PETITION NO. 1289 OF 2025 DIGAMBAR VITTHALRAO DATAR
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Mr. Jadhav Hanumant P., Advocate for the petitioner Ms. Chaitali R. Choudhari, APP for Respondent-State ....
CORAM : SANDIPKUMAR C. MORE AND ABASAHEB D. SHINDE, JJ.
DATED : 07/05/2026 P. C. :
1.
None for the petitioner.
2.
It appears that pursuant to the complaints of the petitioner dated 06/12/2024 and 13/06/2025, an FIR was lodged and the investigation has also been completed. The charge-sheet has been filed under Section 299 of the Cr.P.C., as the accused is absconding. As such, nothing survives in the present petition. Despite these observations, learned counsel for the petitioner had sought time on the last occasion. However, today he remained absent. Thus, it appears that nothing survives in the present petition and the same stands disposed of.
3.
Later on, learned counsel for the petitioner appeared and pointed out that despite lapse of one year, the police have not arrested the accused in the aforesaid matter, especially when her
2 975 wp 1289-25 statement in the cross-complaint has been recorded by them. Be that as it may, since the police have filed the charge-sheet showing the accused as absconding, we deem it appropriate to direct the concerned Police Station to take necessary steps for securing the presence of the accused.
