Learned counsel for the petitioner submits that in the earlier audit report for the year 2022-23, the amount of misappropriation was shown to be around Rs.48 crores. However, in the subsequent audit covering the period from 2017 to 2023, the amount of misappropriation has been ascertained to be around Rs.154 crores. Learned counsel for the petitioner, therefore, contends that a fresh FIR is required to be registered.

However, learned APP submits that the crime is being investigated by the Economic Offences Wing and undertakes to place a status report of the investigation on record through the concerned Investigating Officer.
