BENCH AT AURANGABAD 960 CRIMINAL WRIT PETITION NO. 1462 OF 2025 RAM SURYBHAN KHADE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for the Petitioner : Mr. Shashikant E. Shekade h/f Mr. Jadhav N. L. AGP/APP for Respondent/State : Mr. P.S. Patil ...

CORAM : SANDIPKUMAR C. MORE AND ABASAHEB D. SHINDE, JJ.

Heard.

2.

Learned counsel for the petitioner submits that the petitioner was provided with police protection earlier since March 2022 free of cost. However, in the month of January 2025, his gun license was cancelled and the protection provided to him was also withdrawn. The representation made by the petitioner on 11.04.2025 for restoring his police protection as before, was also rejected. For that purpose, the present Writ Petition has been filed.

3.

Learned counsel for the petitioner further submits that in the month of November 2025, the petitioner was brutally assaulted and was admitted to Sancheti Hospital. He was even in coma for almost two weeks.

4.

According to the learned counsel for the petitioner, the petitioner has brought in the light so many corruption matters and therefore, there is eminent danger to his life. As such, the petitioner is requesting vsj..

2 960.doc for restoration of his earlier police protection in view of the subsequent facts in respect of assault on him.

5.

As against this, learned APP submits that the matter can be remitted back to the concerned police station for considering the request of police protection by the petitioner in the light of subsequent facts of assault as mentioned above.

6.

However, the record shows that wife of the petitioner after the incident of assault on him in the month of November 2025 has also filed a fresh application dated 19.12.2025 before the concerned authority for restoring the police protection earlier granted to the petitioner. Admittedly, after withdrawing the police protection, assault endangering the life of the petitioner has been made and therefore, the application dated 19.12.2025 filed by the wife of the petitioner needs to be considered in the light of subsequent events. 7.

In view of the same, we dispose of this Writ Petition with direction to respondent No.4 to consider the application dated 19.12.2025 filed by the wife of the petitioner for providing the police protection to the petitioner as granted earlier, in the light of assault made on the petitioner in the month of November 2025. 8.

Accordingly, we deem it appropriate to direct the respondent No.4 that the Committee formed for the special purpose should decide the said application in any case within a period of two weeks. The Criminal Writ Petition stands disposed of.
