The present Writ Petition is filed with following prayers: "B.

By issuing appropriate writ, order or direction in like nature, kindly quashed and set aside the impugned FIR bearing Crime No.156/2018 registered with Vedant Nagar Police Station, Dist. Aurangabad for the offences punishable under Sections 406, 409, 420, 465, 468, 471 r/w 34 of Indian Penal Code as well as proceeding i.e. Criminal M.A. No.1356/2019 pending before the learned Chief Judicial Magistrate, Aurangabad.

By an Order of this Court kindly direct the Led. CJM, Aurangabad to accept the report submitted by Respondent No.1 in Criminal M.A. No.1356/2019 filed on 21.06.2019 and also take necessary steps as per law to that effect."

Mr. Gangakhedkar, learned Advocate appearing for petitioners invites attention of this Court to 'C' Summary Report filed by Investigating Officer before Chief Judicial Magistrate, Aurangabad. Apparently, 'C' Summary Final Report No.4/2019 is pending for consideration before learned Magistrate since

(2) 951-cwp-1613-2025.odt 25.03.2019. It is submitted that till this date, no decision is taken, although notice is issued to complainant on 22.07.2019. 3.

The learned Advocate appearing for complainant on instructions makes statement that in fact complainant has no objection if 'C' Summary Report is accepted.

In that view of matter, Writ Petition is disposed of with direction to learned Chief Judicial Magistrate, Aurangabad to consider and decide 'C' Summary Report in Criminal M. A. No.1356/2019 pending before him since 21.06.2019 within period of two months from today. In case adverse order is passed against petitioners, they shall be at liberty to take up appropriate proceedings as permissible in law.
