It appears from the record that affidavit in evidence was filed by respondent/wife in the proceeding under Prevention of Women from Domestic Violence Act in the month of February 2025. Further, it appears that since she remained absent for further chief examination, the petitioner, through his advocate, had given an application for closing the evidence of the respondent/wife on 05.05.2025. Learned advocate for the respondent/wife has also given say on the said application. However, thereafter it appears that the respondent/wife did not lead further evidence. Even no order has been passed by the concerned Judicial Magistrate, First Class on the application dated 05.05.2025 at Exh.85.

Learned counsel for the petitioner submits that now the

(2) 929 Cri.WP-1650.2025.odt further date in the said matter is kept on 19.12.2025. As such, call explanation from the concerned Judicial Magistrate, First Class, Nanded as to why the order was not passed on application Exh.85 since 05.05.2025.
